دہلی ہائی کورٹ نے حمید الله بھٹ کو قومی اردو کونسل سے ہٹانے کا حکم دیا 

یہ انصاف کی اور اردو کی جیت ہے صرف میری یا جاوید رحمانی کی نہیں  :پروفیسر لطف الرحمان 

نئی  دہلی ،9 دسمبر  2011:قومی اردو کونسل کے موجودہ داغی ڈائریکٹر حمید الله بھٹ کو دہلی ہائی کورٹ نے اسکے عھدے سے ہٹانے کا حکم دیا اور کہا کہ اس عھدے پر وہ58 سال کی عمر تک ہی  رہ سکتا ہے واضح رہے کہ ابھی اسکی عمر 59 سال سے زیادہ ہے .اسی کے ساتھ دہلی ہائی کورٹ نے CBI کو بھی حکم دیا کہ اسکے خلاف بد عنوانی کا جو معاملہ اس نے درج کیا تھا  اس کی پوری چھان بین کرکے دس ہفتے کے اندر عدالت میں کلوزر رپورٹ  داخل کرے واضح رہے کہ ایچ بھٹ کو CBI نے2005 میں گرفتار کیا تھا مگر جب یہ2009 میں اسی عھدے پر دوبارہ بحال ہونے میں کامیاب ہو گیا تو اپنے سیاسی اثر و رسوخ کا فائدہ اٹھا کر اس نے وہ کیسسرد بستے میں ڈلوا دیا تھا .جسکی پھر سے با ضابطہ انکوائری کا عدالت عالیہ نے حکم دیا .اسی کے ساتھ اسکے خلاف وزارت براے فروغ انسانی وسائل میں بھی ایک انکوائری چل رہی تھی .اسکے بارے میں ہائی کورٹ نے وزارت سے کہا کہ دس ہفتے میں اس پر اپنی رپورٹ داخل کرے اور یہ بھی بتاے کہ اسکے خلاف کیا کاروائی کی گئی .ڈاکٹر ایچ بھٹ کے خلاف پروفیسر لطف الرحمان اور جناب جاوید رحمانی نے فروری2011 میں ایکPIL دہلی ہائی کورٹ میں داخل کی تھی .جس میں اس کے پورے داغ داغ کیریئر کا حوالہ دیکر اسکو بر طرف کرنے کا مطالبہ کیا گیا تھا .جس پر جب دہلی ہائی کورٹ نے حکومت سے جواب طلب کیا تو ملزم مسٹر ایچ بھٹ نے جناب جاوید رحمانی پر حملہ بھی کیا اور انھیں قومی اردو کونسل سے نکالنے کی کوشش بھی کی .اسکے باوجود بہر حال دہلی ہائی کورٹ میں اسPIL پرسماعتوں کا سلسلہ جاری رہا . 4 نومبر 2011 کی سماعت میں دہلی ہائی کورٹ کی دو رکنی بنچ نے سرکاری وکیل سے ایفی دوٹ مع آفس آرڈر داخل کرکے بتانے کو کہا تھا کہ جب ملزم ایچ بھٹ کی تقری کے آرڈر میں درج ہے کہ وہ ریٹائر 58 سال کی  عمر میں ہوگا تو وہ ابھی تک یہاں کیا کر رہا ہے ؟ اس سماعت میں سرکاری وکیل نے ایفی دوٹ تو داخل کیا تھا مگر کوئی ٹھوس قانونی جواز اسکی وہاں موجودگی کا نہیں پیش کر سکا اور نہ اسکا دفاع بد عنوانی کے معاملات میں کر پایا .اس ایفی دوٹ پر اسکے با وجود سرکاری وکیل اور جناب جاوید رحمانی کے وکیل شری ارجن حرکاولی (Arjun Harkauli)کے درمیان بحث ہوئی .جسکو سننے کے بعد ایکٹنگ چیف جسٹس جسٹس راجیو سہائے نے اپنا فیصلہ محفوظ رکھا تھا جو آج دیا گیا جسکے تحت جسٹس راجیو سہائے نے مذکورہ بالا ہدایات وزارت براے فروغ انسانی وسائل ،حکومت ہند کو اور سی بی آئ (CBI)کو دیں .پروفیسر لطف الرحمان اور جناب جاوید رحمانی نے اس فیصلے کا خیر مقدم کیا اور کہا کہ یہ انصاف کی اور اردو کی جیت ہے جس سے اردو مخالف قوتوں کو سبق لینا چاہیے خواہ وہ اردو اداروں کے اندر ہوں یا باہر .پروفیسر لطف الرحمن نے یہ بھی کہا کہ یہ اردو کی سیاست کے ایک تاریک عھد کا خاتمہ ہے جسکا خیر مقدم ہمارے وزیر براے فروغ انسانی وسائل کپل سبل صاحب کو بھی کرنا چاہیے اور انھیں اس شخص کو ترنت معطل کرنے کے ساتھ ہی یہ عھد بھی کرنا چاہیے کہ آئندہ انکی موجودگی میں ایسے افراد اردو اداروں پر مسلط نہ ہونگے .

حمید الله بھٹ کی برطرفی سے متعلق PIL کی سماعت کے دوران طویل بحث

اگلی سماعت 9 نومبر 2011 کو ،جج نے حکومت سے ایفی دیفٹ (Affidavit)داخل کرنے کو کہا

نئی دہلی :4 نومبر 2011 : حمید الله بھٹ کی برطرفی کے سوال پر داخل جناب جاوید رحمانی اور پروفیسر لطف الرحمن کی PIL پر آج سماعت ہوئی جس میں دونوں فریقین کے وکیلوں کے درمیان زبردست بحث ہوئی اور جج نے سرکاری وکیل سے پوچھا کہ جب حمید الله بھٹ کی تقرری کے آفس آرڈر میں صاف لکھا ہے کہ اس کا تقرر پانچ سال کیلئے کیا جاتا ہے یا اس وقت تک کیلئے جب تک اسکی عمر58 سال کی ہو جائے ،تو یہ ابھی تک قومی اردو کونسل میں کیوں ہے ؟تو سرکاری وکیل سے اسکا کوئی جواب نہ بن پڑا.چنانچہ دہلی  ہائی کورٹ کے ججوں کی دو رکنی بنچ نے سرکاری وکیل کو حکم دیا کہ اس بات کی وضاحت کیلئے ایفی دیفٹ داخل کریں اور اگلی سماعت 9 نومبر 2011 کو رکھی .واضح رہے کہ قومی اردو کونسل کے موجودہ ڈائریکٹر حمید الله بھٹ کے   خلاف یہ PIL جناب جاوید رحمانی اور پروفیسر لطف الرحمن نے دہلی ہائی کورٹ میں داخل کی تھی جس پر 9 فروری 2011 کو کورٹ نے نوٹس جاری کیا جس کے بعد حمید الله بھٹ نے جناب جاوید رحمانی پر حملہ بھی کیا اور 12 فروری 2011 کو  فروغ اردو بھون میں دونوں کے درمیان زبردست ہاتھا پائی ہوئی ،جس کی رپورٹ بھی جناب جاوید رحمانی نے سریتا وہار پولیس اسٹیشن میں اسی دن درج کرا دی تھی .اس PIL میں انہوں نے حمید الله بھٹ کی اہلیت پر سوالیہ نشان قائم کیا اور کہا ہے کہ 1997 میں جب اسکو قومی اردو کونسل کا ڈائریکٹر بنایا گیا اس وقت بھی تعلیمی  اہلیت کے اعتبار سے یہ اس عہدے کا اہل نہیں تھا اور وزارت براے فروغ انسانی وسائل نے اس کا تقرر  بغیر کسی Recruitment Rules کے بھی کیا جو غیر آئینی ہے اور اس سے پہلے اس پر کشمیر یونیورسٹی اور جامعہ ہمدرد میں بد عنوانی کے الزامات لگ چکے تھے اور یہ ان جگہوں سے نکالا جا چکا تھا .اور 1995 میں اسکو جامعہ ملیہ اسلامیہ میں OSD بنایا گیا تو بد عنوانی کے معاملے میں اس کی شہرت کا یہ عالم تھا کہ جامعہ کمیونٹی نے زبردست احتجاج کیا اور اسکو جوائن Join نہیں کرنے دیا گیا .ان سب حقائق کو نظر انداز کر کے وزارت براے فروغ انسانی وسائل کی سیلکشن کمیٹی نے شمس الرحمن فاروقی کی ایما پر قومی اردو کونسل کے ڈائریکٹر کے لئے بے غیر انٹرویو کے تین لوگوں کے ناموں کا پینل بنایا جس میں پہلا نام حمید الله بھٹ کا رکھا گیا اور دوسرا محمود ہاشمی (ڈپٹی  ڈائریکٹر آل انڈیا ریڈیو )کا اور تیسرا نوید مسعود (ڈائریکٹر ڈیپارٹمنٹ آف ایجوکیشن )کا .اس پینل میں موجود باقی دونوں لوگ اس پر علمی اعتبار سے بھی فوقیت رکھتے تھے اور ایڈمنسٹریٹو تجربے کے اعتبار سے بھی .مگر ان پر اس کو ترجیح دی گئی .اور پھر دو سال کے بعد بغیر Recruitment Rules کے ڈائریکٹر کی Term Post کے Against اس کو Permanently ابزورو کر لیا گیا .اس PIL میں اسکے appointment اور absorption دونوں کو غیر قانونی بتایا گیا ہے اور اس عہدے پر سے 2005 میں اسکی گرفتاری کا بھی حوالہ دیا گیا ہے اور حمید الله بھٹ کو ترنت برطرف کرنے کی مانگ کی گئی ہے .جس کی کئی سماعتیں ہو چکی ہیں پہلے یہ جسٹس دیپک مشرا اور جسٹس سنجیو کے کھنا کی پنچ کے سامنے تھی اور انکے سپریم کورٹ چلے جانے کی وجہ سے اب دوسری دو رکنی بنچ کے سامنے ہے اور وکیل جناب ارجن ہرکولی (Shri Arjun Harkauli) ہیں اور امید ہے کہ بہت جلد حمید الله بھٹ کی قسمت کا ستارہ ڈوبنے والا ہے .

اردو کونسل کے ڈائریکٹر حمید الله بھٹ کی بر طرفی سے متعلق  PIL کی سماعت14 ستمبر 2011 کو  جسٹس دیپک مشرا اور سنجیو کے کھنا کی بنچ کے سامنے تھی .اس میں جناب جاوید رحمانی اور پروفیسر لطف الرحمن نے بھٹ کی اہلیت پر سوالیہ نشان قائم کیا اور اس  سے متعلق بد عنوانی کے معاملات کا حوالہ دیکر بھٹ کی برطرفی کا مطالبہ کیا ہے ،اس معاملے کے وکیل  جناب ارجن حرکاولی ہیں اور عدالت عالیہ نے اس مسئلے پر حکومت ہند ،وزارت براے فروغ انسانی وسائل اور قومی اردو کونسل سے جواب طلب کیا تھااور سماعت کی تاریخ پہلے 20 اپریل 2011 اور پھر 13 جولائی 2011 اور پھر14 ستمبر  2011 کو رکھی تھی  .جس پر حکومت نے اب جواب دیا ہے  اور  قومی اردو کونسل نےپہلے ہی  نہایت مبہم سا جواب داخل کیا تھا  جس میں غیر متعلق باتوں کی بھرمار سے عدالت کو گمراہ کرنے کی کوشش کی گئی ہے .حکومت ہند کےجواب میں بھی کوئی خاص بات نہیں بلکہ بھٹ کو عدالت کے رحم و کرم پر چھوڑ دیا گیا ہے اور اسے بچانے کی کوئی خاص کوشش نہیں کی گئی ہے . اس موقعے پر عدالت میں  جناب جاوید رحمانی موجود تھے اور انکے وکیل شری ارجن حرکاولی اورحکومت کے وکیل اور انکے ساتھ ملزم کے وکیل بھی موجود تھے   ،اگلی سماعت میں بھٹ کی عدالت کی طرف سے بر طرفی متوقع ہے کیوں کہ عدالت میںبھٹ  کے اور قومی اردو کونسل کے وکیل نے جو جوابات داخل کئے ہیں وہ انتہائی غلط اور گمراہ کن ہیں اور حکومت کے وکیل نے بھی اپنے جواب میں اسے بچانے کی کوشش نہیں کی ہے  . واضح رہے کہ  2005 میں ستمبر میں  بھٹ کو سی بی آئ(CBI) نے گرفتار کیا تھااور یہ اپنے سیاسی آقاؤں کی مدد سے اپریل   2009میں واپس آگیا جبکہ CBI میں اسکے خلاف مقدمہ ابھی چل ہی رہا ہے اور ایک ڈیپارٹمنٹل انکوائری بھی اسکے خلاف چل رہی ہے اور اب جناب جاوید رحمانی اور پروفیسر لطف الرحمن کی   PIL اسکا خاتمہ بالخیر کرنے کیلئے آ گئی ہے

اردو کونسل کے ڈائریکٹر حمید الله بھٹ کی بر طرفی سے متعلق  PIL کی سماعت آج جسٹس دیپک مشرا اور سنجیو کے کھنا کی بنچ کے سامنے تھی .اس میں جناب جاوید رحمانی اور پروفیسر لطف الرحمن نے بھٹ کی اہلیت پر سوالیہ نشان قائم کیا اور اس  سے متعلق بد عنوانی کے معاملات کا حوالہ دیکر بھٹ کی برطرفی کا مطالبہ کیا ہے ،اس معاملے کے وکیل  جناب ارجن حرکاولی ہیں اور عدالت عالیہ نے اس مسئلے پر حکومت ہند ،وزارت براے فروغ انسانی وسائل اور قومی اردو کونسل سے جواب طلب کیا تھااور سماعت کی تاریخ پہلے 20 اپریل 2011 اور پھر 13 جولائی 2011 کو رکھی تھی  .جس پر حکومت اور وزارت نے ابھی تک کوئی جواب نہیں دیا جبکہ قومی اردو کونسل نے کل نہایت مبہم سا جواب داخل کیا جس میں غیر متعلق باتوں کی بھرمار سے عدالت کو گمراہ کرنے کی کوشش کی گئی ہے .حکومت ہند کے وکیل وہاں موجود تھے.جنکو  عدالت نے ابھی تک جواب نہ داخل کرنے پر پھٹکارا اور چار ہفتے کے اندرہر حال میں  جواب داخل کرنے کا حکم دیا ،اور اگلی سماعت 14 ستمبر 2011 کو رکھی ،واضح رہے کہ اس موقعے پر عدالت میں ملزم حمید الله بھٹ اور جناب جاوید رحمانی بھی موجود تھے ،اگلی سماعت میں بھٹ کی عدالت کی طرف سے بر طرفی متوقع ہے کیوں کہ عدالت میںبھٹ کے اور قومی اردو کونسل کے وکیل نے جو جوابات داخل کئے ہیں وہ انتہائی غلط اور گمراہ کن ہیں واضح رہے کہ  2005 میں ستمبر میں ہی بھٹ کو سی بی آئ(CBI) نے گرفتار کیا تھا جب لکھنئو میں اردو کونسل کا میلہ چل رہا تھا اس ستبمبر میں جب بھٹ کی بحالی کو چیلنج کرنے والی  PIL کی سماعت ہے اس موقعے پر اردو کونسل کا کشمیر میں میلہ چل رہا ہوگا .شاید تاریخ اپنے آپ کو دوہرانے والی ہے اور اردو کا ایک بڑا ادارہ بد عنوانی کے داغ سے نجات پانے والا ہے ،

भट्ट की बरतरफी से मोतालिकPIL की अगली समाअत13  जूलाई2011 को होगी ,यहPIL  श्री जावेद रहमानी और प्रोफ़ेसर लुतफुर रहमान की तरफ से अधिवक्ता श्री अर्जुन हर्काव्ली ने दाखिल की है जिसकी समाअत20जूलाई २०११ को चीफ जस्टिस श्री दीपक मिश्र और श्री संजीव खन्ना की बेंच के सामने थी ,कोर्ट ने भारत सरकार ,मानव संसाधन विकास मंत्रालय और कौमी उर्दू कौंसिल से जवाब तलब किया था ,जिस पर सिर्फ  कौमी उर्दू कौंसिल ने जवाब दाखिल किया ,इसPIL में कौमी उर्दू कौंसिल के डाइरेक्टर हमीदुल्लाह भट्ट की योग्यता पर स्वाल्या निशान कायम किया गया है और उनपर लगे करप्शन के चार्जों का हवाला देकर उन्हें हटाने की मांग की गई

माननीय प्रधान मंत्री ,

 महाशय  ,

आपकी सरकार ने उर्दू की सबसे बड़ी संस्था NCPUL     का निर्देशक एक ऐसे व्यक्ति को बनाया जो उसी संस्था में करोड़ों रूपये की हेरा फेरी कर चूका था !इस फैसले का विरोध पूरे उर्दू जगत ने किया .मगर सिब्बल ने उस चोर को हटाने में दिल चस्पी नहीं ली .उस का जितना विरोध किया गया उन में से कुछ का व्योरा यहाँ देख सकते हैं  www.authorsanjuman.wordpress.com   ,और तो और 27 July2009 को इसको हटाने केलिए  19   सांसदों ने सिब्बल को पत्र लिखा मगर सिब्बल उस भ्रष्ट व्यक्ति (भट्ट)को सुरक्षा प्रदान करते रहे!इन सांसदों ने उसके दो तीन महीने बाद दोबारह श्री सिब्बल को पत्र लिखा और उस भ्रष्ट व्यक्ति का विरोध करते हुए NCPUL के 4  मेम्बरों ने अपना पद त्याग दिया मगर सिब्बल उसे सुरक्षा प्रदान करते रहे 18-01-2010 को श्री जावेद रहमानी ने इस की शिकायत राष्ट्रपति को पत्र लिख का की और राष्ट्रपति ने उनकी शिकायत संख्या P1-D/15599 मानव संसाधन विकास मंत्रालय को भेज दी मगर कुछ नहीं हुआ !उसके बाद श्री मनोज कुमार झा ने आपके कार्यालय  को पत्र लिखा और यह पत्र  PMO ID No,1/3/2010-PMP1/131998 dated 16-03-2010 भी  मानव संसाधन विकास मंत्रालय को श्री आर .के .दास ने भेज दिया मगर श्री सिब्बल अपने छोटे छोटे निजी लाभ में मगन रहे और आपकी सरकार की छवि धूमिल होती रही ,इसके बाद श्री जावेद रहमानी ने आपके कार्यालय से शिकायत की और भट के भ्रष्ट व्यवहारों के बारे में विस्तार से लिखा यह पत्र  PMO ID No.1/3/2010-PMP1/121083 dated 19-02-2010भी उचित कार्यवाही हेतू श्री दास ने  मानव संसाधन विकास मंत्रालय को भेज दिया ,मगर  मानव संसाधन विकास मंत्रालय ने कुछ नहीं किया !  और पिछली  9 Feb2011 को तो उसके खिलाफ जन हित याचिका(PIL) दायर की गई , और जिस व्यक्ति यानी भट  ने अवैध रूप से निर्देशक के पद पर 13  साल से क़ब्ज़ा किया हुआ है ,जिसके विषय में मंत्रालय द्वारा गठित कमिटी(Goyal Committee) ने अपनी रिपोर्ट में लिखा है कि उसकी शैक्षणिक योग्यता उस पद योग्य नहीं थी और उसे अवैध रूप से नियुक्त किया गया ,जिसके खिलाफ CBI   की जाँच अपने अंतिम निष्कर्ष तक नहीं पहुंची और जारी है ,जिसके विषय में मंत्रालय में भी जाँच चल रही है !उस व्यक्ति को CBI   द्वारा गिरफ्तार किये जाने का सिला यह दिया गया कि उसे एक और अतिरिक्त पद मंत्रालय में दिया गया और April 2009   में उस पद पर भी भेज दिया गया जहां से   CBI  ने उसे गिरफ्तार किया था !और सारा भारत विरोध कर्ता रहा मगर सिब्बल ने उसके खिलाफ कुछ नहीं किया इस लिए अब उसका हौसला इतना बढ़ गया है कि उसने12 Feb 2011  को याचिका कर्ता से मार पीट की और उन्हें यानी श्री जावेद रहमानी को  जान से मारने की धमकी दी !उसकी इस हरकत की निंदा करते हुए श्री सिब्बल को इन लोगों ने पत्र लिखा ,

और उसे तुरंत उस पद से हटाने को कहा .मगर सिब्बल को इस व्यक्ति से पता नहीं कौन सा ऐसा लाभ पहुँच रहा है कि उसके लिए वह सब की अनदेखी कर रहे हैं और इस संस्था का उपयोग अपने निजी लाभ के लिए कर रहे हैं !मुझे सूचना के अधिकार के अंतर्गत एक तो यह बताया जाये कि प्रधान मंत्री के कार्यालय के आदेश की अनदेखी करने पर 1- क्या श्री सिब्बल से कोई जवाब तलब किया गया ?2-या प्रधान मंत्री का  कार्यालय सिर्फ शिकायत  मानव संसाधन विकास मंत्रालय को भेज कर निश्चिन्त हो गया ?अगर हाँ तो हम अपने शासन तंत्र से क्या उम्मीद रखें ?यही कि श्री सिब्बल द्वारा इतनी छूट पाने वाला यह गुण्डा जब  जन हित याचिका कर्ता की जान ले लेगा तो आपका कार्यालय खेद प्रकट करके अपनी ज़िम्मेदारी से मुक्त हो जायेगा ?

दुसरे  मानव संसाधन विकास मंत्रालय से यह पता करके बताया जाये कि इस के विरुद्ध आज तक जो शिकायतें आती रही हैं जिन में से केवल कुछ का व्योरा  www.authorsanjuman.wordpress.com  & www.cfess.blogspot.com पर मौजूद है उन में से किन किन शिकायतों पर  मानव संसाधन विकास मंत्रालय ने क्या क्या किया ?और यह भी कि जन हित याचिका कर्ता पर हमले की निंदा करते हुए जो पत्र श्री सिब्बल को भेजा गया उस पर क्या कार्यवाही की गयी ?

३.जिन दिनों भट के खिलाफ जन हित याचिका दायर की गयी उन्हीं दिनों यानी 6 Feb 2011 को एक ऐसी संस्था (हरमैन सोसाईटी )द्वारा श्री सिब्बल ने भट को एवार्ड दिया ,यह देखे बिना कि यह प्रोग्राम NCPUL की फंडिंग से किया गया अतः इस में NCPUL के tainted निर्देशक को एवार्ड(Award) देना अपने आप में अवैध और सरकारी पैसे से निजी लाभ अर्जित करने जैसा है ,और फिर हरमैन सोसाईटी ने उर्दू के छेत्र में कोई काम नहीं किया अतः यह उर्दू के बारे में कुछ कहने योग्य नहीं ,इन सब बातो को छोड़ दे तो भी प्रश्न यह उठता है कि इस प्रोग्राम और एवार्ड(AWARD) द्वारा क्या सिब्बल यह पैग़ाम देना चाहते थे कि वह उस भ्रष्ट व्यक्ति के साथ हैं ?

४ .कौमी उर्दू काउन्सिल की  मासिक पत्रिका उर्दू दुनिया है उस के Agust 2009,September 2009,May 2010,July 2010,September 2010 ,January 2011,Feb2011 &March 2011   के अंको में श्री सिब्बल की तस्वीरे छपी हैं ,हम जानते हैं कि उर्दू साहित्य से श्री सिब्बल का कोई लेना देना नहीं ,तो इन तस्वीरों के इस पत्रिका में प्रकाशित करने की मंशा क्या है ?और क्या श्री सिब्बल की आज्ञा से उनके निजी हित के लिए इन सरकारी पैसो का इस तरह  उपयोग किया गया है ?या कही श्री सिब्बल ने उस भ्रष्ट व्यक्ति को जो सुरक्षा दे रखी है यह उसकी कीमत तो नहीं ?

मेरे इन तमाम प्रश्नों का उत्तर सूचना के अधिकार के अंतर्गत दिया जाये जिसके लिए १० रूपये का पोस्टल आर्डर संलग्न है और जवाब देने के साथ साथ कार्यवाही भी की जाये ताकि हमारे लोकतंत्र की मर्यादा सुरक्षित रहे और प्रधान मंत्री कार्यालय का आदर और सम्मान भी !

Hamidullah Bhat, Director, NCPUL, Delhi, Arrested for Fraud

Mr. Hamidullah Bhat, the erstwhile Director of the National Council for Promotion of Urdu Language (NCPUL), an Advisory Body of the Ministry of Human Resource Development, Government of India, was arrested on 30 September 2005 After the Central Bureau of Investigation (CBI), an intelligence agency under the office of the Prime Minister of India, conducted a raid on his house and office premises. As per the reports which appeared in print and electronic media Mr Bhat, during his tenure as the Director of the council, had amassed assets worth more than Rs.2.2 crores in New Delhi and the National Capital Region (NCR) alone as per the documents seized. Apart from the cash recovered by the CBI, the sources confirmed in the media that the market value of his assets is more than ten times the amount indicated in the documents. According to the newspaper reports, Mr. Bhat’s assets in Kashmir are not included in the estimate and the CBI will look into them at a later stage.

          Mr. Bhat began his career in Delhi in 1990 as an OSD (Officer on Special Duty) in the Jamia Hamdard, where he was elevated to Registrar. He subsequently resigned, in 1995, much before the completion of his tenure, amid charges of corruption. He was later appointed as an OSD of the Jamia Millia Islamia but was unable to take up the post owing to the protest of students and teachers over his corrupt practices at the Jamia Hamdard. Prior to Jamia Hamdard, now a central university in New Delhi, Mr. Bhat was a Deputy Registrar at the Kashmir University where, again, he was known for his nefarious activities. He became the Director of the NCPUL in 1998. NCPUL has an annual budget of Rs. 12 crore, and all of his assets under scrutiny were acquired after he assumed responsibility at the council. Sources in the Ministry of Human Resource Development confirme that the services at Kashmir University were transferred to the Ministry of HRD during the BJP (Bhartiya Janta Party) rule with several omissions in the service rules, even while his first appointment in the Kashmir University as an Assistant Registrar was politically enabled and did not conform to the relevant norms of the Union Public Service Commission. A CBI officer was quoted by media saying, “ Though it is difficult to immediately explain how Mr. Bhat amassed properties, it is clear that he was misusing his powers as the Director of the NCPUL. As Director, he was handling all the projects that the council was handling [sic]. He had been under watch for a while.” Such arrests are rare and undertaken only if the accused falls under the exceptionally corrupt category on the basis of recovery of cash and documents. He has been suspended from the services and will remain so unless he is exonerated in the trial in the subordinate court.

          The NCPUL is now operating under a nominated body of members and vice chairman. The Minister of Human Resource Development is the ex-officio Chairman and noted critic Shamsur Rahman Faruqi is the Vice Chairman, Mr. Bhat had made the NCPUL an outlet of the RSS [Rashtriya Swayamsevak Sangh] during the BJP rule.

          The CBI initiated a probe against Mr. Bhat and put him under watch following the publication of my article, “ The Great Urdu Fraud,” in the New Delhi English fortnightly Milli Gazette. The article appeared in two consecutive instalments (1-15 and 16 – 31 May 2005) and highlighted Mr. Bhat’s involvement in one of the projects of the council.

ORDER

Closure report has been filed. The case of the prosecution is that Dr. Hamidullah Bhat while working in HRD Ministry had amassed huge assets both movable and immovable which are disproportionate to his known sources of income.

Check period in this case is stated to be between 1997 to 30 September, 2005. It has been alleged that the total income of Dr. Hamidullah Bhat from salary and other allowances during a period from January 1997 to December 2005 was 59, 61,522/-. He had acquired the following immovable assets:

(i)           House no.86, block no. V Surajkund, Erose Garden, Faridabad, Haryana three-storey building with basement purchased and constructed during 1999 -- 2001 for Rs.25,00,000/-.

(ii)          A Maruti car Wagon R having registration no DL 2 CN 5090 for Rs.3,50,000/-

(iii)        purchase of land and construction of building for opening a school Al-Aim, Sr. Sec school at Hyderpura, Airport, Srinagar.

(iv)        Purchase of land at Plot no.39, Dyal Bagh Faridabad, Haryana for running Shemrock school for Rs. 8,76, 724/-.

Total assets of the accused were worth Rs.41.76 lakhs in his name or in the name of his family members. It has further alleged that he was having a lavish lifestyle and keeping in view his expenditure and likely savings the DA had been calculated 1394. FIR was accornidngly registered against the accused.

In the closure report it is stated that in the course of investigation it has been revealed that the assets of the accused prior to the check period including one house at Srinagar at D-3, Gulbarg co-operative Society, Peer Bagh, Shrinagar, Flat No. 95/III, Surajkund, Faridabad, Haryana (already disposed) and balance in SB 3383 in the name of Mr. & Mrs Bhatt at J& K Bank, Lajpat Nagar, New Delhi as on 31.12.96 was of Rs.75, 517/-.

The assets calculated of the accused at the end of check period included the following immovable properties i.e (i) Property number 86 block-V Erose Garden, Surajkund, Faridabad, Haryana in the name of wife of the accused namely Mrs. Asmat Ara valued at Rs 4, 50, 000/-- and construction of the same was calculated at Rs. 12, 50, 000/-, (ii) D 2 Noor Nagar, Jamia Nagar, New Delhi in the name of the accused valued at Rs.  8, 63, 500/--.

Total immovable assets were calculated at Rs. 25, 63, 500/- and the movable assets calculated at the end of check period were worth Rs.48,60,811/- which included cash recovered from the house search of accused of Rs.1,14,300/-.

          The income details have also been mentioned in the closure report but the rent calculated for the period November 1999 to March 2004 of Rs.5,59,325/- has not been substantiated and no details of the property from where this rent accrued has been made. Similarly a sum of Rs.4,60,000/- has been calculated as the income of the accused i.e. sale proceeds of old house at 3/G –II booked Eros Garden, Faridabad, Haryana but when and from which source of money this house has been purchased has not been investigated. A sum of Rs 10 lakhs has been calculated as the income of the accused being the amount received from Dr. Ishtiyaq Shafie Ahmad brother in law of  accused and statement of Dr. Ishtiyaq Shafie Ahmad to the said effect recorded by the IO has been perused wherein it is stated that he has paid a sum of Rs 10 lakhs to his sister Ms. Asmat Ara from his NRI account which was in consideration of her share of the ancestral properties as a final settlement but what was the final settlement and it was in view of which ancestral properties has not been stated and there is also no investigation on the point as to what amounts has been received by other siblings of Dr. Ishtiyaq Shafie. This amount in my view appears to be suspect as the same person i.e brother-in-law of accused had also purchased the house from the wife of the accused i.e 95/III Suraj Kund , Eros garden, Faridabad, Haryana for Rs. 15, 00, 000/- and no details of the said transactions have also been placed on record.

          The expenditure chart shows that the accused had several LIC policies and in September, October 2002 itself he had purchased 3 policies where the annual premium was more than 70,000/-

In the closure report it has further been mentioned that accused has formed a Society, i.e. Society for Human Empowerment, of which he was the Chairman and heavy donations had been received from various individuals and organizations for the purpose of Society but there is no evidence that the assets of the society had been converted into the account of the accused and as such the income/expenditure in the said society cannot be attributed to the accused.

I am not in agreement with this course of investigation adopted by the Investigation Officer.

Statement of S.Maitra is relevant in this regard. He has stated that he being the Branch Manager of the Bank of Maharashtra, Dayal Bagh, Faridabad branch has received a proposal from Chairman Dr. M.Hamidullah Bhat of the society for Human Empowerment for a loan, and the party executed the necessary documents and collateral security of the property and personal guarantee of Dr. Bhat and Mrs. Asmat Ara wife of the accused was given. Statement of Shri. Brij Bhushan Sehgal Proprietor of M/s Brij Bhushan Sehgal & Sons, Muzaffarnagar U.P. Decinder Brothers, Muzaffarnagar U.P.& M/S Brothers Muzaffarnagar U.P. is to be effect that he had given Rs.25 lacs loan to this Society from his three proprietorship firms and Rs.5 lacs has since been refunded.

Statement of Nitin Patil Proprietor of M/s Nitin Builders is to the effect that he had given unsecured loan of Rs. 5 lacs to the society for Human Empowerment on 4.06.2003 & loan was subsequently returned on 29.03.2005 i.e. within one and a half years. Smt. Sheeba Fehmi has stated that during her tenure in NCPUL she met Dr. Hamidullah Bhat who had constituted a society for empowerment of minorities and she had attended one such meeting but thereafter she left the society. There have been no investigation on this count as to why such heavy amounts of loan had been extended to the Society for Human Empowerment of whom the Chairman and In-Charge was Dr. Hamidullah Bhat and from which sources of the Society these loans were thereafter returned and refunded within such a short span of time. Modern Float Glass India Pvt Ltd, Modern Enterprises C.V. Jain, Nitin Builders, Modern Timber and Plywood had also given unsecured loans of Rs. 5 lacs each to the society; The statement of witnesses shows that these loans had also been returned by the society within short span of time but the investigation has not been carried out on these lines which could reflect the source of income and money of the society who had returned these amounts within such short periods of time, why such heavy unsecured loans was given in the first instance is also not investigated.

In the closure report there is also no mention or detail given about the source of the income for the acquisition of plot no. 39, Dyal Bagh, Faridabad, Haryana and its constructions for running Shemrock School. Shri. S.K. Rampal who had been directed to conduct investigation on the valuation of this property had evaluated its cost of construction 3,48,04,700/-which had been submitted to SP.

The immovable property i.e House No. 86 Block no. V Erose garden has also been evaluated by S. K. Rampal after inspection and the cost of construction as per this report works out to Rs.25,26,900/- source of money for this construction has not been investigated. In the closure report the valuation done by the private contractor has been given as 12,50,000/- which has been accepted. There is also no investigation carried out of the immoveable property acquired by the accused i.e D-2 Noor Nagar, Jamia Nagar, New Delhi, Okhla which was also acquired during the check period and valued at worth Rs.8,63,500/-.

In view of the evidences which has been collected by the prosecution, I am not inclined to accept the closure report which is accordingly rejected.

Further investigation be carried out.
